JUSTICE SHIVAJI PANDEY ORAL ORDER 09-02-2021 Heard learned counsel for the petitioner and learned counsel for the State as also counsel for the Informant. In this case, the petitioner is seeking bail in connection with Bibhutipur P.S. Case No. 63 of 2020 registered for offences under sections 366A/34 of the Indian Penal Code. In the present case, the girl has gone along with the nephew of the petitioner, namely, Sachin Kumar. It appears that the daughter of the Informant was getting training of sewing and, later on, both of them developed relationship with each other and he took away the girl.
As has been informed that the girl has filed a criminal writ for getting protection to her life as she has apprehension that she may be harmed by the Informant side.

No.36361 of 2020(2) dt.09-02-2021 2/2 Learned counsel for the Informant submits that the girl is 16 years of age and she is still traceless but, the girl has approached this Court for getting proper protection. Looking to the entire facts and circumstances of the case as also considering the fact that the petitioner is the uncle, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-II, Rosera in connection with Bibhutipur P.S. Case No. 63 of 2020, subject to the condition that (i) one of the bailors shall be a close relative of the petitioner and (ii) the petitioner would cooperate the proceeding of the court below. In event of failure to appear on two consecutive dates, the court below will be at liberty to pass the order, including cancellation of bail bonds.
