The petitioner apprehends his arrest in Dehri (T) P.S. Case No. 91/2016, registered for the offence punishable under Sections 353, 379, 411 of the Indian Penal Code, Section 4(1-A), 21(1) of D.E. Act, Section 40(1) of B.M. Act and Sections 33, 41 and 42 of the Indian Forest Act.
The informant a police officer alleged that one Haiwa Dumpher was intercepted and the driver was apprehended. The driver disclosed that Sonu Singh is the owner of vehicle, was indulged in illegal mining of chips and he was carrying chips on the vehicle.
It is submitted that petitioner is neither owner of the
Patna High Court Cr.Misc. No.20824 of 2016 (2) dt.20-05-2016 2/2 vehicle nor the vehicle was seized. Name of the petitioner figured in this case on the confessional statement of Arvind Ram driver of the vehicle, but nothing has been brought on record to show that the petitioner is the owner of the vehicle.
Considering the facts aforesaid, the petitioner abovenamed, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the learned Sub-divisional Judicial Magistrate, Dehri in connection with Dehri (T) P.S. Case No. 91/2016, subject to the conditions as laid down under Section 438(2) of the Cr. P.C. (Prabhat Kumar Jha, J.) Vinita/- U T
