JUSTICE VIKASH JAIN ORAL ORDER 03-04-2015 It is stated that the petitioner no.5, namely, Lakhan Chaudhary, has already been arrested and as such his application has become infructuous.

2. As prayed, the anticipatory bail petition as against petitioner no.5, namely, Lakhan Chaudhary, is permitted to be withdrawn and is dismissed as such.

3. Heard learned counsel for the petitioners and learned APP for the State.

4. The petitioners nos.1 to 4 apprehend their arrest for the offences alleged under Sections 323, 324, 326 and 307 of the Indian Penal Code registered in connection with Warsaliganj P.S. Case no.94 of 2014.

5. It is submitted that the petitioners have been falsely implicated and parties are Gotias and there is a case and counter case.

6. Having regard to the nature of accusations as well as injury reports showing grievous in nature sustained by Baleshwar Choudhary and Parwati Devi, this Court is not inclined to grant anticipatory bail to the petitioners. The anticipatory bail petition stands dismissed.
