JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 05-04-2021 Heard learned counsel for the petitioner and State. The petitioner is in custody in connection with Siwan Town P.S. Case No.410 of 2019 for the offence under Sections 364(A)/34 of the Indian Penal Code.

Learned counsel for the petitioner submits that the petitioner was not named in the F.I.R. He further submits that the victim in his statement recorded under Section 164 of the Cr.P.C. has not alleged any overt act against this petitioner. He further submits that the victim himself appeared and there is no case of any demand or payment of ransom. The petitioner is in custody since 03.06.2020.

Considering the aforesaid, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.50,000/- (Rupees fifty thousand) with two sureties of the

Patna High Court CR. MISC. No.36043 of 2020(3) dt.05-04-2021 2/2 like amount each to the satisfaction of Judicial Magistrate, 1st Class, Siwan in connection with Siwan Town P.S. Case No.410 of 2019.
