JUSTICE RAKESH KUMAR ORAL ORDER 20-05-2016 Heard Sri Ravi Shankar Sahay, learned counsel, who was assisted by Sri Ajay Nandan Sahay, learned counsel for the petitioner and learned Addl. Public Prosecutor. The sole petitioner apprehends his arrest in connection with Kudra P.S. Case no.85/2016 registered for the offence under Sections 47 of the Bihar Excise (Amendment) Act, 2016.
It was submitted by learned counsel for the petitioner that it is true that from Khalihan of the petitioner, about 400 Liters of country liquor was recovered, but the petitioner was having no connection with the said liquor. Learned counsel for the petitioner submits that only with a view of implicate the petitioner, some one had put the said country liquor. On the aforesaid ground,
Patna High Court Cr.Misc. No.22533 of 2016 (2) dt.20-05-2016 2/2 a prayer has been made for grant of anticipatory bail. Keeping in view the fact that from Khalihan of the petitioner, such huge quantity of liquor was recovered, it is not a fit case for extending the privilege of anticipatory bail. The petition stands dismissed.
