JUSTICE MOHIT KUMAR SHAH ORAL ORDER 02-05-2018 After some arguments, the learned counsel for the petitioners seeks permission to withdraw the present writ petition with liberty to the petitioners to approach the concerned authority for the purposes of making complaints regarding the irregularities committed during the course of the appointments made to the Class IV posts which are subject matter of the present writ petition.

The learned counsel for the Respondents has drawn attention of this Court to a judgment dated 17.04.2018 passed in

Patna High Court CWJC No.17454 of 2017(2) dt.02-05-2018 2/2 C.W.J.C. No. 14136 of 2017, whereby and whereunder it has been postulated that "though in such cases where the appointment letters have already been issued, the selected candidates have joined or are on the process of joining duties, in such cases also, the High Court may cause an inquiry upon receipt of appropriate complaints and after following the due process, it may annual the selection, if the same is found to be illegal".

In view of the aforesaid, the writ petition is disposed of as withdrawn with liberty to the petitioners to approach the appropriate authority with regard to their grievances regarding the selections made in Bettiah Judgeship on Class IV posts. In case, the petitioners make such complaints within a period of three weeks from today, the appropriate authority shall take appropriate action and dispose of the complaints in accordance with law.
