4. The Deputy Collector, Revenue Division, Water Resources Development Department, Patna .... .... Respondent/s ====================================================== Appearance :

For the Petitioner/s : Mr. Gajanan Arun For the Respondent/s : AAG III ====================================================== CORAM: HONOURABLE THE CHIEF JUSTICE ORAL ORDER 19-08-2017 This application has been filed for restoration of CWJC No. 6351 of 1997 which is said to have been dismissed for want of prosecution on 11.09.2001. However, records indicate that CWJC No. 6351 of 1997 was decided on merit on 07.11.2003 by a detailed order passed and thereafter LPA No. 1186 of 2003 was filed which has also been dismissed by an order passed by a learned Division Bench of this Court on 12.12.2003.

In view of the aforesaid fact, it is clear that CWJC No. 6351 of 1997 has been dismissed on merit and subsequently LPA filed has also been dismissed. Therefore, there is no question of restoration of CWJC No. 6351 of 1997.

Patna High Court MJC No.2602 of 2001 (2) dt.19-08-2017 2/2 This application is therefore dismissed.
