The petitioners are apprehending arrest in a case registered for the offences punishable under Sections 120B, 420, 467, 468, 471, 323 and 504 of the Indian Penal Code. Prosecution case is that co-accused Anjani Kumar executed a sale deed with respect to a piece of land, which in fact belonging to the informant, Ram Bahadur Mahton. Petitioner no.1, Baleshwar Mahton, is the identifier whereas petitioner no.2 Ramanand Mahton is the purchaser of the land. It is submitted by learned counsel for the petitioners that in fact informant filed mutation case for getting his name mutated over the land in question, which was objected by co-
Patna High Court Cr.Misc. No.22726 of 2016 (2) dt.20-05-2016 2/2 accused Anjani Kumar. Ultimately, the mutation case was dismissed. Hence, in the background of land dispute the accusation has been levelled. Considering the same, co-accused Anjani Kumar, the seller of the land, has been granted anticipatory bail vide Criminal Miscellaneous No.19195/2016 Considering the aforesaid facts, let the above named petitioners be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the learned ACJM-1, Begusarai, in connection with Mansoorchak P.S. Case No.45/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C. (Dinesh Kumar Singh, J) Ashwini/- U T
