====================================================== CORAM: HONOURABLE MR. JUSTICE PRABHAT KUMAR SINGH ORAL ORDER 26-06-2025 Heard learned counsel for the petitioner and the State.
2. The petitioner apprehends arrest in a case registered for the offence punishable under sections 318(4)/338/336(3)/340(2)/352/308(3)/3(5) of the Bharatiya Nyaya Sanhita, 2023.
3. Petitioner is alleged to have sold land of the informant showing wrong boundary.
4. Learned counsel appearing for the petitioner submits that the petitioner is innocent and has falsely been implicated in this case. petitioner being real owner, sold the land to one Vikash Kumar and said Vikash Kumar has filed Title Suit no. 487 of 2023, which is pending in the Court of Jub judge III, Saharsa. Proceeding under section 145 Cr.P.C. order was passed in favour of the petitioner. Moreover the matter is purely of civil nature for which civil remedy is available to the informant.

5. Considering the aforesaid facts of the case, prayer for bail of the petitioner is allowed. In the event of arrest/surrender within eight weeks from today, let the petitioner, mentioned above, be enlarged on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Saharsa in Saharsa Sadar Police Station Case No. 1303/2024, subject to the conditions laid down under section 482 of the Bharatiya Nagarik Suraksha Sanhita, 2023.
