JUSTICE MADHURESH PRASAD ORAL ORDER 02-11-2021 Earlier the appellant had preferred an appeal under Section 14A(2) of the SC/ST Act against the order dated 17.07.2019 passed by Additional Sessions Judge 1st cum Special Judge, SC/ST Act, Vaishali at Hajipur. The same was dismissed by order dated 01.06.2020 passed in Cr. Appeal (SJ) No.5840(SJ) of 2019. Without approaching the court of Additional Sessions Judge 1st cum Special Judge SC/ST Act, Vaishali at Hajipur, again an appeal has been filed against the same order dated 17.07.2019.

Learned counsel for the appellant, after some arguments, submits that he would again be approaching the court of Additional Sessions Judge 1st cum Special Judge SC/ST Act, Vaishali at Hajipur Having regard to order of last rejection and other

Patna High Court CR. APP (SJ) No.3465 of 2021(7) dt.02-11-2021 2/2 factors, this Court would only observe that the Court below should consider the same upon its merits without being in any way affected by the rejection of earlier bail application. The appeal stands disposed of accordingly.
