1. Heard learned counsel for the petitioner and learned APP for the State.

2. Petitioner seeks regular bail in connection with Rafiganj P.S. Case No. 84 of 2023, dated 22.02.2023 registered for the offences punishable under Sections 414 and 401/34 of the Indian Penal Code.

3. The main submissions advanced by learned counsel Mr. Pramendra Kumar Singh appearing for the petitioner are that the instant matter relates to the recovery of a Bolero vehicle which was suspected to be stolen and as per the allegation the petitioner was found sitting in the said vehicle with co-accused Shatrughan Kumar but the said allegation is completely false, in fact the petitioner is the co-villager of the said Shatrughan Kumar and he took lift in the said vehicle and he was bonafidely traveling in the said vehicle when he was

Patna High Court CR. MISC. No.43787 of 2023(2) dt.24-07-2023 2/2 apprehended with co-accused. Further submissions are that though against the petitioner there are criminal antecedent of three cases but details of these cases surfaced in the statement of the petitioner which was given by him after his arrest in the present matter and he is twenty one years old young person and also a student and he has been languishing in jail since 06.04.2023 and against him the investigation has been completed.

4. Learned APP Mr. Nagendra Prasad appearing for the State opposes the prayer for bail.

Having regard to the facts and circumstances of this case, considering the above submissions and mainly petitioner's young age and the completion of investigation against him, in my opinion, it is a fit case for bail to the petitioner. Accordingly, let the petitioner named-above be enlarged on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the concerned Court in connection with Rafiganj P.S. Case No. 84 of 2023.
