Since in view of the decision of this Court rendered in Sita Devi Vs. Bihar State Khadi and Village Industries Board [2004 (4) PLJR 565], now there can be no distinction between the employees working under non-plan head on the basis of 1979 Restructuring Scheme and the employees working under the Departmental Unit coupled with the fact that the State Government vide Annexure-R appended with the reply to the counter affidavit has already given necessary direction on 23.11.2007 itself, there cannot be order by the competent authority for not granting the dues of the petitioner including the first and second time bound promotion.
On such averments having been made, this writ application is being disposed of with a direction to the Bihar State
Patna High Court CWJC No.12806 of 2009 (4) dt.03-03-2016 2/2 Khadi and Village Industries Board to calculate the amount and pass necessary orders and make payment of admissible dues to the petitioner within a period of three months from the date of receipt/production of a copy of this order.
