1. Heard the parties.

2. Petitioner apprehends his arrest in connection with Tajpur PS Case No. 125 of 2022 dated: 20.03.2022 registered for the offence under Section 304B, 201 / 34 of the IPC.

3. As per the FIR, the petitioner killed the daughter of the informant due to non fulfillment of dowry demand within seven years of marriage and disposed the dead body without informing anybody.

4. Learned counsel for the petitioner submits that petitioner is the husband of the deceased and marriage was solemnized in the year 2018, however, no dowry demand was made by the petitioner and in fact the deceased died due to illness and information in this regard was given by the petitioner

5. Regard being had to the submission made by the parties, taking into consideration nature of allegation, the fact that deceased has died an unnatural death in her matrimonial home within seven years of marriage, there is allegation of dowry demand against the petitioner and there is presumption under Section 113B of the Evidence Act against the petitioner, as such, I am not inclined to grant anticipatory bail to the petitioner.
