The petitioner apprehends his arrest in Complaint Case No. 825 of 2013, corresponding to Trial No. 2823 of 2014 registered for the offences punishable under Section 498A of the Indian Penal Code.
The complainant alleged that the petitioner solemnized marriage with her in the year 2011. She went to her Sasural, but her husband and other in-laws subjected her to mental and physical torture and caused abortion.
It is submitted that the complainant is not the legally

Pinki Devi, daughter of Arun Kark was married to Binod Mahto, son of Sitaram Mahto, resident of village - Bairiya, District - Dhanusha, Nepal. The voter list is annexed as Annexure-5, at serial no. 211 and 411 show that Pinki Kumari Mahto is wife of Binod Mahto Sudi.
None appears on behalf of the complainant.
Considering the facts aforesaid, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate, 1st Class, Madhubani in Complaint Case No. 825 of 2013, corresponding to Trial No. 2823 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
