JUSTICE DINESH KUMAR SINGH ORAL ORDER 23-01-2015 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 341, 323, 504 and 506 of the Indian Penal Code and Section 3 (I) (X) of the SC/ST (Prevention of Atrocities) Act.

The accusation is of making assault and abusing the informant by calling caste name.

It is submitted by learned counsel for the petitioner that the informant has subsequently retracted from his initial version. A statement has been made in para 3 of the petition that the petitioner has no criminal antecedent.

The aforesaid facts constitute good ground for consideration of regular bail.

Let the learned court below consider the prayer for

Patna High Court Cr.Misc. No.1716 of 2015 (3) dt.23-01-2015 2/2 regular bail of the petitioner if he surrenders within a period of six weeks in connection with Chiraiya P.S. Case No. 352 of 2013 pending in the court of learned SDJM, Sikerhana at Motihari. Accordingly, the application is disposed of.
