The petitioner apprehends his arrest in a case registered for the offences punishable under Section 498 A of the Indian Penal Code.

Petitioner, who happens to be husband of the complainant, is said to have performed second marriage with the complainant after demise of his first wife and tormented her over dowry demand and finally drove her out from the marital house.

It is submitted by learned counsel for the petitioner that the petitioner has no concern with the aforesaid occurrence.

Patna High Court CR. MISC. No.39244 of 2019(5) dt.20-09-2019 2/2 Petitioner has neither made any dowry demand nor tormented her nor drove her out from the marital house over the said demand. Petitioner is an army personnel and complainant does not want to live with the petitioner despite his readiness to keep her with full honour and dignity. Notice sent to the complainant by the Court returned unserved with the report of the process server that both the brothers and father of the complainant have divulged that the complainant has performed marriage with some other person and is living at some unknown place. Petitioner has been enlarged on provisional bail by this Court. Considering the facts and circumstances of the case, the provisional bail granted to the petitioner vide order 02.07.2019 by a coordinate Bench of this Court is hereby confirmed.
