JUSTICE ANIL KUMAR UPADHYAY ORAL ORDER 22-03-2021 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner is in custody in connection with Pothia P.S. Case No. 86 of 2020 registered for the offences under Sections 302, 376DA/34 of the Indian Penal Code and Sections 4, 6 of the Protection of Children From Sexual Offences Act.

Having regard to the nature of allegation levelled in the present case, this Court is not inclined to grant privilege of bail to the petitioner. The prayer for bail stands rejected.

However, the Court below is directed to

Patna High Court CR. MISC. No.35968 of 2020(3) dt.22-03-2021 2/2 expedite the trial and conclude the same at the earliest, preferably within a period of nine months from the date of receipt/production of a copy of this order. If the trial is not concluded within the specified period of time, the petitioner may approach this Court to renew his prayer for bail.

With the aforesaid observation, the petition stands rejected.
