The petitioner, who is in custody since 18.08.2020, seeks bail in connection with Teghra P. S. Case No. 235 of 2020 dated 16.08.2020, instituted for the offences under Sections 414 and 120 (B) of the Indian Penal Code and Sections 30 (a) and 40 (1) (2) of the Bihar Prohibition and Excise Act, 2016.
It appears from the prosecution report that 326.34 litres of liquor has been recovered from the possession of the petitioner and others.
The learned counsel for the petitioner has submitted that the recovery has wrongly been shown in
Patna High Court CR. MISC. No.35821 of 2020(2) dt.20-01-2021 2/2 the name of the petitioner. The seizure list has not been signed by any independent person.
The petitioner has clean antecedents.
Considering the afore-stated facts and taking into account the period of custody of the petitioner, he is directed to be released on bail on his furnishing bail bonds in the sum of Rs. 10,000 /- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Additional District & Sessions Judge II cum Special Judge, Excise Act, Begusarai, in connection with Teghra P. S. Case No. 235 of 2020.
The petition stands allowed.
