1. Heard learned counsel for the parties.

2. The petitioner has preferred this application for grant of regular bail in connection with Guraru P.S. Case no.41 of 2024 registered under section 392 of the Indian Penal Code.

3. As per the prosecution case, the informant states that while he was going in front of the school talking on his mobile phone, two accused persons on a motorcycle snatched his mobile phone and escaped.

4. Learned counsel for the petitioner submits that the FIR was registered against unknown. The petitioner was falsely implicated in course of investigation when allegedly the stolen motorcycle was recovered from his possession. Contrary to the allegation, no incriminating article has been recovered from the petitioner's possession who has been falsely implicated in the

Patna High Court CR. MISC. No.41060 of 2024(3) dt.30-08-2024 2/2 case because of his antecedent. The petitioner is in custody since 18.3.2024 and chargesheet has been submitted in the case.

5. Heard learned A.P.P. for the State.

Having heard learned counsel for the parties and taking into consideration the allegations against the petitioner in the FIR, the material that has transpired in course of investigation as is evident from the order of the learned trial Court together with the petitioner having remained in custody since 18.3.2024 and chargesheet having been submitted in the case, the Court directs the petitioner to be enlarged on bail in connection with Guraru P.S. Case no.41 of 2024 on furnishing bail bond of Rs.10,000/ (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned A.C.J.M. 10th, Gaya.
