The present M.J.C. application dismissed due to non-compliance of peremptory order dated 30.07.2013 against opposite party nos. 5(f) and 5(g).

The present application is filed for restoration of M.J.C. No. 1423 of 2001, which is with regard to transfer of Title Appeal No. 10 of 1983 and 17 of 1983 pending in the Court of District Judge, Nalands at Biharsharif to this Court for being heard and disposal along with First Appeal No. 191 of 1983 on the ground that the said appeals arise out of common judgment of trial Court in two analogous suits i.e. T.S. Nos. 52/1994 and 53/1978. In such circumstances, this M.J.C. application will be deemed to be dismissed in its entirety due to common interest of all the opposite parties.
