23-11-2021 At the outset, learned counsel for the petitioner seeks permission to make correction in paragraph 13 of the bail petition with regard to date of custody of petitioner. Permission is accorded. It may be done in course of the day.

Heard learned counsel for the parties.

The petitioner seeks bail in Sessions Trial No. 44 of 2021, arising out of Ariyari P.S. Case No. 129 of 2020, registered for the offence under Sections 302, 201, 120(B) of the Indian Penal Code and Section 27 of the Arms Act. As per the prosecution case, on 10.12.2020 at about 11 :00 AM, this petitioner alongwith other co-accused persons, under a conspiracy, took away the father of the informant and committed his murder and thereafter, threw his dead-body in the bush.

Patna High Court CR. MISC. No.48851 of 2021(2) dt.23-11-2021 2/2 It is submitted on behalf of petitioner that petitioner happens to be wife of the deceased and informant is her own son. From bare perusal of F.I.R., it is apparent that only on suspicion petitioner has been made accused. Only allegation against this petitioner is that she had illicit relation with coaccused Afjal Ansari since long and the deceased used to oppose this. Petitioner is alleged to be one of the conspirator and the thrust of the allegation is against co-accused Kundan Kumar. Petitioner has got clean antecedent and he is in custody since 12.12.2020. Investigation is complete.

Learned A.P.P. for the State has opposed the bail petition.

Considering the nature of allegation and period of custody, the bail petition of petitioner is allowed. Let the above named petitioner be released on bail on furnishing bail-bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned District & Sessions Judge, Sheikhpura in connection with Sessions Trial No. 44 of 2021, arising out of Ariyari P.S.
