The petitioner apprehends his arrest in Complaint Case No. 864 of 2013, registered for the offences punishable under Sections 307/34 and other Sections of the Indian Penal Code. Petitioner was married with the complainant in the year 1999 but on account of some family dispute, the petitioner filed divorce case and the complainant also the present case. Learned counsel for the petitioner submits that the petitioner is ready to keep his wife.

Considering the facts aforesaid, the petitioner, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy

Patna High Court Cr.Misc. No.34937 of 2014 (2) dt.13-03-2015 2/2 of this order, is directed to be enlarged on provisional bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Nawadah in connection with Complainant Case No. 864 of 2013, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. Thereafter the learned court below shall issue notice to the complainant, the court below shall make effort to resolve the dispute. If the dispute is resolved provisional bail granted to the petitioner shall be confirmed. If the dispute is not resolved, the court will pass order on merit on provisional bail of the petitioner.
