JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 17-09-2015 The instant application under section 482 of the Code of Criminal Procedure has been filed for quashing the order dated 24.09.2013 passed by the learned Judicial Magistrate 1st Class, Patna in Trial No. 3133 of 2013 arising out of Shastri Nagar P.S.Case No. 342 of 2013, by which the learned Magistrate has taken cognizance of the offence under section 393 of the Indian Penal Code.

After some arguments, learned counsel for the petitioners seeks leave to withdraw this application in order to raise all the points available to the petitioners at the stage of framing of charge.
