The petitioner seeks bail in connection with Samastipur Muffasil P. S. Case No.281 of 2021, instituted for the offences under Sections 420, 467, 468, 471, 120(B) of the Indian Penal Code and Sections 30(a), 41(i)(ii) of the Bihar Prohibition and Excise Act, 2016.

The learned counsel for the petitioner submits that the petitioner is in custody since 24.06.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case.

Allegation is of recovery of 2106.900 litre of English wine while the same was being unloaded from a truck and it is

The learned counsel for the petitioner submits that the petitioner is a labourer and was not knowing, what was on the truck which he was asked to unload.

The learned A.P.P. for the State opposes the bail application.

Considering the fact that the petitioner is in custody since 24.06.2021, he is a person with clean antecedent and charge-sheet has been submitted in the case, the petitioner, above-named, is directed to be released on bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Additional Sessions Judge-2-cum-Special Judge Excise, Samastipur in connection with Samastipur Muffasil P. S. Case No.281 of 2021.

The application stands allowed.
