JUSTICE SAMARENDRA PRATAP SINGH ORAL ORDER 13-03-2015 Heard learned counsel for the petitioners and the State.
The petitioners apprehend their arrest in a case under Section 5, 8, 13 and 14 of the Bihar Saw Mills (Regulation) Act, 1990 and Section 41, 42 and 52 of the Indian Forest Act, 1989, pending in the court of Judicial Magistrate, 1st Class, Motihari, East Champaran.
Learned counsel for the petitioners denies the allegation that the saw Mill in question, which is being run without license/permit, belong to them.
Having regard to the facts and circumstances of the case, in the event of arrest or surrender before the court below
Patna High Court Cr.Misc. No.38030 of 2014 (2) dt.13-03-2015 2 / 2 within four weeks from today the petitioners, named above, be released on anticipatory bail on furnishing bail bond of Rs.5000/- (Five thousand) each with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st Class, Motihari, East Champaran in connection with Forest Official Complaint Case no. 143 of 2010, subject to the conditions as laid down under Section 438 (2) Cr.P.C. with the condition that the petitioners would cooperate in the trial.
