JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 24-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner seeks pre-arrest bail in connection with Nauhatta P. S. Case No. 245 of 2015 registered under Sections 341, 504, 324, 307, 323, 379 and 506/34 of the Indian Penal Code. It is contended that though the petitioner Tajijjur Rahman @ Chhote @ Tafijjur Rahman is alleged to have inflicted a farsa blow on the head of the informant, the injury report would indicate that the only injury caused on the head of the informant was simple and superficial in nature.

Regard being had to the nature of injury sustained by the informant as would appear from perusal of medical report as

No.21216 of 2016 (2) dt.24-05-2016 2/2 contained in Annexures 2 and 3 to the present application, in the event of arrest or surrender before the court below within six weeks from today, the petitioner named above is directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate-III, Saharsa in Nauhatta P. S. Case No. 245 of 2015, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
