The petitioner apprehends his arrest in Halsi P.S. Case No. 67 of 2014, registered for the offences punishable under Sections 365 and 34 of the Indian Penal Code. The informant made allegation that the petitioner along with Dhananjay Kumar and Karu Pandey kidnapped his son Patanjali Kumar Pandey for the purpose of marriage. The victim also named the petitioner along with other accused persons who took him to different temples and forcibly got him married. Learned counsel for the petitioner submits that the petitioner has falsely been implicated in the case on account of village politics.
Since there is very specific allegation against the
Patna High Court Cr.Misc. No.909 of 2015 (2) dt.12-01-2015 petitioner that he along with other accused persons kidnapped the victim and forcibly got him married, hence I am not inclined to enlarge the petitioner on anticipatory bail. Accordingly, the same is rejected.
However, the petitioner, if so advised, may surrender before the court below and pray for regular bail and his prayer shall be considered on its own merit without being prejudiced by this order.
