1. Heard learned counsel for the petitioners and learned A.P.P. for the State.
2. The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 126(2), 115(2), 109, 75 and 3(5) of the BNS.
3. Learned counsel for the petitioners submits that petitioners are persons with clean antecedent and petitioners no. 5, 6 and 7 are women and the informant alleges that on 07.01.2025 the accused persons including the petitioners came
Patna High Court CR. MISC. No.37625 of 2025(2) dt.18-06-2025 2/3 and Umesh Mahato (petitioner no. 1) assaulted her by an iron rod on her back while Chhathu Mahato (petitioner no. 3) torn her clothes. Thereafter, Satan Mahato (petitioner no. 2) assaulted the informant by farsa twice on her head causing injury and thereafter Rajan Mahato (petitioner no. 4) assaulted her husband by an iron rod causing injury on head while women accused assaulted Chanda Devi.
4. Learned counsel for the petitioners submits that petitioners have been falsely implicated in the instant case by the informant. It is further submitted that petitioners and the informant are agnates and are having dispute relating to property. It is next submitted that on account of dispute relating to property, an altercation took place in which both sides assaulted each other. It is also submitted that in order to give seriousness to the case, it is alleged that Satan assaulted the informant by farsa twice causing injury on head but then it is submitted that from perusal of the order impugned, it would manifest that the injury of the injured has been opined to be simple which amply demonstrates that petitioners never had any intention of committing a serious occurrence.
5. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioners.

Considering the submissions made by the learned counsel for the petitioners, let the petitioners above-named, in the event of their arrest or surrender before the learned Court below within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned court below where the case is pending/Successor Court in connection with Yogapatti P.S. Case No. 43 of 2025, subject to the conditions as laid down under Section 438 (2) of the Cr.P.C. (Satyavrat Verma, J) Kundan/- U T
