This application for grant of anticipatory bail arises out of Bhabua P.S. Case No. 203 of 2016, disclosing offences under Section 290 of the Indian Penal Code and Section 47(a) of the Bihar Excise Act.
Learned counsel for the petitioner has submitted that it is for the first time that the petitioner has been made accused in a case under Section 47(a) of the Bihar Excise Act. He has further submitted that allegedly 38 liters of country made liquor was recovered from the house of one Uma Ram and with the allegation that the petitioner was godown Manager, he has been made accused in the case. He further submits that nothing has been recovered from the premises belonging to this petitioner.
Patna High Court Cr.Misc. No.22061 of 2016 (4) dt.20-06-2016 Considering the submissions as above, this application is allowed.
Let petitioner above-named in the event of his arrest/surrender within four weeks from today in the Court below be released on bail on furnishing bail bond of Rs. 10,000/-(ten thousand) with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Kaimur at Bhabua in connection with Bhabua P. S. Case No. 203 of 2016, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
This is subject to the condition that the petitioner shall present himself before the Police/Court, as the case may be, as and when required and in the event of failure on his part to appear before the Court on two consecutive occasions, his bail bond shall be liable to be cancelled.
