JUSTICE MOHIT KUMAR SHAH ORAL ORDER 19-09-2022 Though the present writ petition was filed for reconstruction of the records of Title Appeal No.30 of 1999 pending before the learned Court of Sessions Judge-I, Kishanganj, however, the learned counsel for the respondentState has filed a supplementary counter affidavit, wherein, it has been submitted that all the relevant records have now been submitted before the learned Court below.
In such view of the matter, the learned counsel for the petitioner seeks a direction upon the learned Court below, to decide his Title Appeal, expeditiously.
Having regard to the facts and circumstances of the case, the present writ petition stands disposed off with a
Patna High Court CWJC No.3777 of 2018(5) dt.19-09-2022 2/2 direction to the learned Court below to go through the records of the case and evaluate as to whether all the records are available or not and in case it is found that certain documents are still wanting, it shall summon the concerned authority to furnish the same, and in case the same is not furnished, liberty is reserved to the learned Court below to take appropriate coercive action against the concerned authority for disobedience of the order of this Court. This exercise is directed to be completed within a period of four weeks from today, whereupon the Title Appeal is directed to be adjudicated on merits, preferably within a period of one year, thereafter.
The petitioner is granted liberty to file a simple I.A. in the present case, in case need so arises.
The writ petition stands disposed off on the aforesaid terms.
