25-05-2016 Heard learned counsel for the petitioner and learned counsel for the State.

The petitioner apprehends his arrest in relation to Motipur P.S. Case No. 274 of 2015 registered under Sections 47(A) of the Excise Act. The date of occurrence is 02.10.2015, the time of State Assembly Election. It is alleged that from the custody of petitioner substantial amount of unripe spirit was recovered. Learned counsel for the petitioner states that as per the First Information Report itself there was no recovery from conscious possession of the petitioner.

Be that as it may, in the event of his arrest/surrender before the court below within four weeks, let the petitioner, namely, Jagarnath Mahto, be enlarged

Patna High Court Cr.Misc.
