The petitioner seeks bail in Spl. Case No. 49/2018 (D.R.I. Patna P.S. Case No. 49/2018) arising out of DRI/LZU/PRU/718(II)Eng-II/2018 dated 23.05.2018 instituted for the offences under Sections 20, 23, 25 and 29 of N.D.P.S. Act.

The earlier bail application of the petitioner was rejected vide Annexure-1 to the present application taking into account that 293.7 kg of ganja was recovered from the constructive possession of the petitioner and as such the petitioner was not entitled for bail under Section 37 of N.D.P.S.

A report was called for from the Trial Court. It has been reported that one witness has partly been examined. On behalf of the Union of India, Mr. Manoj Kumar Singh, it is submitted that as per his instruction, out of five witnesses, 3 prosecution witnesses have already been examined. Considering the nature of accusation and the stage of the case, I am not inclined to grant bail to the petitioner. The same is rejected. The Trial Court is directed to take all necessary steps to expedite the case and conclude the trial at the earliest preferably within a period of six months from the date of receipt/production of a copy of this order. It goes without saying that prosecution shall cooperate during the trial and get the remaining prosecution witnesses examined within the stipulated period of time.
