JUSTICE RAKESH KUMAR ORAL ORDER 18-03-2017 On call, none appeared on behalf of the petitioner either to press this petition or to make a prayer to adjournment. Sri Kumar Priya Ranjan, learned Central Government Counsel submits that this is the third writ petition for the same relief. For the first time, a writ petition was filed for a direction to make appointment on compassionate ground, which was disposed of by passing a speaking order. Thereafter, second writ petition was filed by the present petitioner vide C.W.J.C.No.5027 of 2004, which was dismissed on 24.04.2005, primarily on the ground that in absence of any vacancy, there was no question to direct for appointment on compassionate ground. He submits that the issue, which has been raised in the present writ petition, has already been set at rest.
Be that as it may since none appeared on behalf of
Patna High Court CWJC No.2443 of 2009 (3) dt.18-03-2017 2/2 the petitioner, the writ petition stands dismissed due to nonprosecution. (Rakesh Kumar, J) NKS/- U
