The petitioners apprehend their arrest in Piprakothi P.S. Case No. 38/2014, registered for the offences punishable under sections 147, 149, 341, 323, 324, 307, 379 and 504 of the Indian Penal Code. The informant named 10 persons including the petitioners and alleged that Ravindra Rai assaulted Rameshwar Rai, the son of the informant. Panna Lal Rai assaulted Rameshwar Rai with Pharsa on his head. Ram Pravesh Kumar @ Ram Prashev Kumar petitioner no. 2 is alleged to have assaulted Rohit Kumar with sword on his head. Ram Kishore Rai and Tetari Devi are alleged to have assaulted Ranju Kumari with spade. It appears that there is specific allegation of assault against Ram Kishore Rai and Ram Pravesh Kumar with sword and spade and

Patna High Court Cr.Misc. No.2211 of 2015 (3) dt.10-03-2015 corresponding injuries are found. Hence I am not inclined to enlarge the petitioner no. 1 Ram Kishore Rai and petitioner no. 2 Ram Pravesh Kumar @ Ram Prashev Kumar on anticipatory bail and the same is rejected. So far as, case of petitioner no. 3, 4 and 5 Tetari Devi, Girija Devi and Badri Devi @ Baduri Devi is concerned, they are ladies, there is omnibus and general allegation against them and there is counter version, they abovenamed are directed, in the event of their arrest or surrender before the court below within a period four weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount is to the satisfaction of Sri Girish Mishra, the Learned Judicial Magistrate Ist Class, Motihari, East Champaran in connection Piprakothi P.S. Case no. 38 of 2014, subject to the conditions as laid down under Section 438(2) of the Cr. P.C.
