The petitioner is apprehending his arrest in a case registered for the offences punishable under Section 366A of the Indian Penal Code.

The prosecution case is that the minor daughter of the informant namely, Rijwana Khatoon went traceless on 24.01.2016 when the neighbour of the informant suggested that the petitioner enticed away the daughter of the informant.

It is submitted by learned counsel for the petitioner that in 164 Cr.P.C. the victim has suggested that she of her own married with the petitioner and got her age recorded as

Patna High Court Cr.Misc. No.22918 of 2016 (2) dt.24-05-2016 2/2 18 years since the father wanted to marry her with a lame person. The 164 Cr.P.C. statement of the victim has been brought on record as Anenxure-2 by way of supplementary affidavit.

A statement has been made in paragraph 3 of the petition that the petitioner has no criminal antecedent. Considering the aforesaid facts, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned court below within a period of twelve weeks from today, on furnishing bail bonds of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Muzaffapur in connection with Katra P.S. Case No. 10 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
