JUSTICE GOPAL PRASAD ORAL ORDER 15-06-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. This is a petition for grant of anticipatory bail to the petitioner for the offences under Sections 376, 376(B), 354, 354(B), 120 (B), 149, 307 and 311 of the I.P.C. It is alleged that the marriage of the informant was solemnized with Shabbar Khan and thereafter father-in-law committed rape in presence of her husband. However, role attributed to the petitioner is that when the victim protested he threatened to eliminate her. On alarm raised by the informant the witnesses collected and asked for panchayat. The petitioner is alleged to have poured kerosene oil from the gallon on the victim and when the father -in-law was to lit the victim witnesses came

Hence, having regard to the fact that the petitioner is mother-in-law and there is allegation of rape against the father-inlaw, let the petitioner, above named, in the event of her arrest or surrender before the court below within two weeks from today, be released on bail on furnishing bail bond of Rs.10,000/- with two sureties of the like amount each to the satisfaction of the C.J.M., Muzaffarpur, in Minapur P.S.Case No.347/15 subject to the conditions as laid down under Section 438(2) of Cr.P.C.
