The petitioner is apprehending his arrest in a case registered under Section 420 and other sections of the Indian Penal Code.

Two persons were apprehended while they were making preparation for cheating innocent people.

The apprehended accused disclosed the name of the petitioner. It is submitted that nothing has been recovered from the possession of the petitioner. Firstly, it was alleged that the motorcycle recovered from the place of occurrence belongs to the petitioner but, during the course of investigation, it has come on enquiry from the District Transport Office that the owner of the motorcycle is one Shant Lal Sharma and not the petitioner. It appears that except the confessional statement of

Patna High Court Cr.Misc. No.2938 of 2015 (2) dt.21-01-2015 2/2 the co-accused, the police has not collected any tangible evidence to show the involvement of the petitioner.

Considering the facts aforesaid, the above named petitioner, in the event of his arrest or surrender before the learned court below within a period of four weeks from the date of receipt / production of a copy of this order, is directed to be enlarged on bail on furnishing bond of Rs. 10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of the Railway Judicial Magistrate, Sonepur in Muzaffarpur Rail P.S. Case No. 31/2014, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
