JUSTICE ASHWANI KUMAR SINGH ORAL ORDER 26-05-2016 Heard learned counsel for the petitioners, learned counsel for the State and learned counsel for the informant. The petitioners seek pre-arrest bail in connection with Inarwa P. S. Case No. 49 of 2013 registered under Sections 364, 302 and 201 of the Indian Penal Code.
Regard being had to the fact that on completion of investigation, the police had submitted final report under Section
Patna High Court Cr.Misc. No.21532 of 2016 (2) dt.26-05-2016 2/2 173(2) of the Code of Criminal Procedure holding therein that there was lack of evidence and the jurisdictional Magistrate had accepted the same but on revision the matter was remanded and thereafter, cognizance has been taken, in the event of arrest or surrender before the court below within six weeks from today, the petitioners named above are directed to be released on bail on furnishing bail bond of Rs.10,000/- ( Rupees ten thousand) with two sureties of the like amount each to the satisfaction of ACJMVIth, Bettiah, West Champaran in Inarwa P. S. Case No. 49 of 2013, subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
