The petitioner seeks bail in Nawada (Town) P.S. Case No. 190 of 2019, instituted for the offence under Section(s) 419, 420, 467, 468, 471, 120(B)/34 of Indian Penal Code and Section 66 of I.T. Act.

In the written report it is alleged that at 2:00 p.m. the informant along with other Police Constable proceeded for duty and when he reached near ICICI ATM at about 9:00 p.m. he saw several persons gathered there apprehending one person. The Police took apprehended person in custody. He disclosed his name as Pratipal Kumar @ Rakesh Kumar. On enquiry, people told that he was withdrawing money from ATM. On

Patna High Court CR. MISC. No.38362 of 2019(3) dt.29-07-2019 2/2 search, Rs.89,000/- cash, Blue Tooth, touch screen mobile phones and two PayTM Card in the name of Manju and Birendra Singh have been recovered from possession of the petitioner.

Counsel for the petitioner submits that petitioner has been arrested merely on suspicion. He has clean antecedent. Considering the aforesaid facts and circumstances of the case, prayer of the petitioner for grant of bail is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Nawada, in connection with Nawada (Town) P.S. Case No. 190 of 2019, subject to the condition that both the bailors will be close relatives of the petitioner.
