JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 19-01-2015 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioner no. 1 is brother in law whereas petitioner no. 2 is gotini of the deceased. Although, the case has been registered under Sections 498A, 304B/34 of the Indian Penal Code and 3⁄4 of Dowry Prohibition Act but submission on behalf of the petitioners is that petitioners reside separately from the husband of the deceased and moreover, no specific overt-act has been attributed against the petitioners.

Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their

No.2168 of 2015 (2) dt.19-01-2015 arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the Chief Judicial Magistrate, Madhubani in Jai Nagar P.S. Case No. 56 of 2014 subject to condition as laid down under Section 438(2) of the Cr.P.C.
