2. In the present case, the petitioner seeks bail in connection with Ballia (Baliya) P.S. Case No. 171 of 2021 registered for the alleged offences under Section 30(a) of Bihar Prohibition and Excise Act.
3. As per prosecution case, police received secret information about bringing of consignment of illicit liquor by the petitioner and other co-accused persons on a four wheeler. A raid was conducted at the identified place and four youths started fleeing away on seeing the police party and co-accused Aman Kumar Paswan was apprehended. From the search of four wheeler, total 560.52 litres of foreign liquor was recovered. The apprehended co-accused disclosed the name of the petitioner
Patna High Court CR. MISC. No.36677 of 2025(2) dt.20-06-2025 2/3 and other co-accused persons who were involved in trading of illicit liquor.
4. Learned counsel for the petitioner submits that earlier the petitioner was granted anticipatory bail by learned Single Judge of this Court vide order dated 25.04.2022 passed in Cr. Misc. No. 57952 of 2021. Thereafter, petition for modification was filed for extension of time granted for surrender of the petitioner but the said petition was dismissed vide order dated 25.08.2023 passed in Cr. Misc. No. 55579 of 2023. Subsequently, Cr. Misc. No. 9393 of 2025 was dismissed as withdrawn by this Court vide order dated 14.02.2025. Learned counsel further submits that the petitioner is in custody since 20.01.2025 and there is no cogent material against him to show his involvement. The petitioner is having antecedent of one case and he is on bail in the said case and charge sheet has been submitted.
5. Learned APP opposes the submission made on behalf of the petitioner.
6. Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the submission of charge and period of custody of the petitioner, the petitioner above named is directed to be released on bail on
Patna High Court CR. MISC. No.36677 of 2025(2) dt.20-06-2025 3/3 furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Exclusive Special Excise Judge-II, Begusarai/concerned Court in connection with Ballia (Baliya) P.S. Case No. 171 of 2021, subject to the conditions mentioned in Section 480(3) of B.N.S.S. and also the following conditions:
(i) One of the bailors will be a close relative of the petitioner.
(ii) The petitioner will remain present on each and every date fixed by the court below.
(iii) In case of absence on three consecutive dates or in violation of the terms of the bail, the bail bond of the petitioner will be liable to be cancelled by the court concerned.
