2. The petitioner apprehends his arrest in connection with Ballia (Balliya) Town (S) P.S. Case No. 32 of 2025 dated 28.01.2025 registered under Section 25 (1-b) a, 26, 27 of the Arms Act.

3. As per the First Information Report, on 28.01.2025, the police party, on the basis of secret information that near Shaktichaur, one person was firing, proceeded towards the place of occurrence and upon seeing the police party, the said person started fleeing away but was arrested who disclosed his name as Md. Shahid. The police recovered a country made pistol and one used cartridge from his possession.

4. Learned counsel for the petitioner submits that petitioner is not named in the FIR and he has been implicated in this case on the basis of confessional statement allegedly, made

Patna High Court CR. MISC. No.39418 of 2025(2) dt.09-07-2025 2/2 by the arrested accused, Md. Shahid from whose possession a country made pistol and one used cartridge were recovered. It is next submitted that the petitioner has got no criminal antecedent of similar nature.

5. Regard being had to the submissions made by the parties, taking into consideration the fact that the petitioner is not named in the FIR and the recovery of a country made pistol and one used cartridge was made from accused, Md. Shahid, I am inclined to grant anticipatory bail to the petitioner.

6. Let the petitioner, above named, be released on anticipatory bail in the event of arrest or surrender before the court below within a period of four weeks from today on furnishing bail bond of Rs. 10,000/- (rupees ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Begusarai in connection with Ballia (Balliya) Town (S) P.S. Case No. 32 of 2025 subject to the condition as laid down under Section 482 (2) of the B.N.S.S., 2023.
