1. Heard learned counsel for the petitioner and learned A.P.P. for the State.

2. The petitioner apprehends his arrest in a case registered for the offences punishable under Sections 191(2), 191(3), 115(2), 117(2), 118(1), 110, 74, 303(2), 352, 351(2) and 3(5) of the BNS.

3. By order dated 18.06.2026, injury report was called for but the same till date has not been received.

4. Learned counsel for the petitioner submits that petitioner is a person with clean antecedent and the informant alleges that her father was coming back from his field, when he was interecepted by the accused persons including the petitioner and petitioner along with Nafis assaulted her father by fist causing injury on his ribs and thereafter accused persons also assaulted her and her family members and Noor along with

Patna High Court CR. MISC. No.37451 of 2026(3) dt.20-07-2026 2/3 Rukhsad attempted to commit rape on her. On objection, Rukhsad assaulted the informant by rod causing injury on her head.

5. Learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case by the informant with an allegation that he along with Nafis assaulted the father of the informant by fist causing injury on his ribs. It is further submitted that a specific pleading has been made at para 13 of the anticipatory bail application that the injured suffered simple injury. It is next submitted that petitioner and the informant are agnates and are having dispute relating to property and allegation of assault is also not specific. It is also submitted that petitioner is not a criminal.

6. Learned A.P.P. for the State opposes the prayer for anticipatory bail of the petitioner.

7. Considering the submissions made by the learned counsel appearing on behalf of the petitioner, let the petitioner, above-named, in the event of his arrest or surrender within a period of six weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs.10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Trial Court where the case is pending/Successor
