This application has been filed for a modification which, according to the learned counsel for the applicant, requires to be carried out as while granting the final relief to the applicant the direction for payment of costs by the learned Single Judge has remained intact even though the appeal has been allowed.
We have heard the learned Additional Advocate General and we find that the prayer is bona fide, inasmuch as the appeal was allowed by us and, it appears, due to inadvertence while finally granting the relief to the applicant the costs imposed by the learned Single Judge to the tune of Rs.50,000/- payable to the Patna High Court Legal Aid Committee was not set aside.
We, accordingly, allow this application to the effect that the costs of Rs.50,000/- as imposed on the State shall also stand deleted from the judgement of the learned Single
Patna High Court MJC No.2207 of 2019(2) dt.10-07-2019 3/3 Judge.
Shri Mangalam is present for the respondent who has not opposed the application.
