1. Heard learned counsel for the petitioner and learned APP for the State.

2. The petitioner seeks bail in anticipation of his arrest in a case registered for the offences punishable under Sections 420, 467, 468, 471 and 34 of the Indian Penal Code.

3. The learned counsel for the petitioner submits that the petitioner is a person with clean antecedent. It is next submitted that informant alleges that 417 candidates including the petitioner submitted fake and forged certificate in pursuance of an advertisement issued for appointment on the post of Junior Engineer.

4. The learned counsel for the petitioner submits that petitioner has been falsely implicated in the instant case. It is next submitted that FIR came to be instituted in haste without

Patna High Court CR. MISC. No.43128 of 2025(3) dt.19-09-2025 2/2 holding an inquiry. It is also submitted that had an opportunity been given to the petitioner to explain his side of the case, perhaps the instant FIR would not have been instituted. It is further submitted that petitioner has not been appointed on the post of Junior Engineer.

5. Learned A.P.P. opposes the anticipatory bail application.

Considering the submissions made by the learned counsel for the petitioner, the petitioner, above-named, in the event of his arrest or surrender before the learned Court below within a period of six weeks, is directed to be released on anticipatory bail on his furnishing bail-bonds in the sum of Rs. 10,000/- (Rupees Ten Thousand) with two sureties of the like amount each to the satisfaction of Smt. Latika Bharti, the learned Judicial Magistrate, 1st Class, Patna in connection with Sachivalya P. S. Case No.39 of 2023, subject to the conditions laid down under Section 438(2) of the Cr.P.C.

7. The application stands allowed.
