JUSTICE DINESH KUMAR SINGH ORAL ORDER 26-05-2016 Heard learned counsels for the petitioner and the State. The petitioner is apprehending arrest in a case registered for the offences punishable under Sections 307, 34 of the Indian Penal Code and 27 of the Arms Act.

It is alleged that the petitioner fired on the informant and his son but none has received any injuries. It is submitted by learned counsel for the petitioner that prior to lodging of the present case the petitioner has lodged Shrinagar P.S. Case No.47/2015, levelling accusation under sections 307/324 and other allied sections of the IPC and wife of the petitioner lodged Shrinagar P.S. Case No.70/2013, levelling accusation under sections 147/148/323/379 IPC, against the present informant. Apart from the present case, the informant has also lodged Shrinagar P.S. Case No.46/2015 against the petitioner,

Patna High Court Cr.Misc. No.23821 of 2016 (2) dt.26-05-2016 2/2 wherein the petitioner has been granted bail. Considering the nature of injury caused to the informant and his son and the cases lodged by the petitioners' side at earlier point of time, let the above named petitioner be released on anticipatory bail, in the event of arrest or surrender before the learned Court below within a period of 12 weeks from today, on furnishing bail bond of `10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the learned Judicial Magistrate, 1st Class, Madhepura, in connection with Shrinagar P.S. Case No.55/2015, subject to the conditions as laid down under Section 438(2) Cr.P.C.
