2. The petitioner seeks bail in Naugachia P.S. Case No. 353 of 2023 registered for the offence punishable under Sections-323, 324, 307, 379, 387/34 of the Indian Penal Code.
3. The specific allegation against the petitioner is that he inflicted knife blows at the abdominal region of the informant's brother. He also assaulted on his hand with knife.
4. It has been submitted on behalf of the petitioner that the petitioner is in custody since 20-10-2023 i.e. near about one year. victim has not supported the occurrence. Both parties are neighbours. There is land dispute between the parties.
5. Mr. J. N. Thakur, learned APP for the State has
Patna High Court CR. MISC. No.42124 of 2024(5) dt.07-10-2024 2/2 opposed the prayer for bail.
6. Considering the aforesaid facts and circumstances, let the petitioner named above, be released on bail on furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Naugachia, Bhagalpur in connection with Naugachia P.S. Case No. 353 of 2023 with condition that the petitioner will appear in the court below on each and every date fixed in the case and if, he fails to do so on two consecutive dates unless he is prevented by extremely adverse circumstances, the learned court below shall be at liberty to cancel the bail bonds of the petitioner.
