JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 19-05-2016 Heard the counsel for the petitioner and the State. The petitioner is the nephew of the informant and is facing prosecution under section 307 IPC vide Amba P.S. Case No. 05 of 2016. The allegation is that owing to the family feud the petitioner assaulted with Lathi on the head of the informant. The contention of the petitioner is that the place of occurrence is not mentioned. Both parties are close agnates and on litigating terms. The injuries found on the scull/head of the informant were not grievous. The petitioner has no criminal antecedents.
The learned APP submits that the two injuries with specification indicated in the injury report were found on the head of the informant which were attributed to the petitioner.
Patna High Court Cr.Misc. No.21724 of 2016 (2) dt.19-05-2016 2/2 Considering the allegation and the injuries sustained by the informant, I am not persuaded to extend the privilege of anticipatory bail to the petitioner. Prayer is accordingly rejected. (Kishore Kumar Mandal, J) HR/- U T
