Petitioners apprehend their arrest in K. Nagar P. S. Case No. 498/2013 instituted for offences punishable under Sections 147, 148, 149, 188, 353, 447, 384, 120 (B) of the Indian Penal Code.
The informant, Circle Officer of K. Nagar P.S. gave a written report that on 20.10.2013 he got confidential information that a mob of miscreants was taking possession over land measuring 18 acre 79 decimal, were armed with deadly weapons. The informant alongwith police party and other officials visited at the place of occurrence and found the accused persons armed with
Patna High Court Cr.Misc. No.2119 of 2015 (3) dt.13-05-2015 2/2 deadly weapons forcibly taking possession over the land. The informant tried to pacify the matter but the miscreants were not ready to vacate the land and hence, F.I.R. was lodged against 100 unknown persons.
The petitioners and the name of other accused persons have come to surface during the course of enquiry and finds place in some paras of the case diary but with no specific allegations. Nor there is any injury caused on any person by the petitioners. Under such circumstances, it is directed that in the event of arrest or surrender within a period of four weeks from today, the above named petitioners Prithvi Mahto and Mukesh Mahto shall be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Purnia in K. Nagar P. S. Case No. 498/2013, subject to condition as laid down under Section 438 (2) of Cr.P.C.
