ANJANA MISHRA ORAL ORDER 30-06-2016 Heard learned counsel for the petitioner and learned counsel appearing on behalf of the State. The petitioner is apprehending his arrest in connection with Manigachhi P.S. case no. 164/2015 for allegedly having committed the offence under Sections 448, 341, 323, 307, 504, 506/34 of Indian Penal Code.
In the present case, case diary was called for which has since been received.
Learned counsel for the petitioner submits that actually it was a case of love affair and upon the threatening being given by the petitioner and others, the girl tried to commit suicide and as a result of which, all the family members of the petitioner
Patna High Court Cr.Misc. No.21482 of 2016 (3) dt.30-06-2016 2/2 including the petitioner have been implicated in the present case. Counsel for the petitioner further submits that the allegation against him as well as his brother Lalan Sahni is general and omnibus.
Considering the aforesaid facts and circumstances and further considering that there is no chance of tampering of evidence, let the petitioner abovenamed, in the event of his arrest or surrender before the Court below within a period of four weeks from the date of receipt/ production of a copy of this order, be released on bail on furnishing bail bond of Rs. 10,000/- (Rs. Ten thousand) with two sureties of the like amount each to the satisfaction of Judicial Magistrate, 1st class, Darbhanga in connection with Manigachhi P.S. case no. 164/2015, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
